Welcome to ai-breaker (ai-breaker.com) (the "Site," "we," or "our"). These Terms of Service ("Terms") are a legal agreement between you and the Site, applicable to your use of our website, mobile applications, and other features or services (collectively, the "Service").
The Service is an AI-powered image generation platform that provides virtual AI-generated products (not physical goods). The Service allows you to generate images through text prompts or by uploading reference images. All products and services provided are digital and virtual in nature. By using the Service, you agree to comply with these Terms. If you do not agree, please do not use the Service.
Age Restriction: The Service is intended for users who are at least 18 years old. By using the Service, you confirm that you are at least 18 years old. For more details, please see our Underage Policy.
1. Acceptance of Terms
By accessing or using the Service, you acknowledge that you accept these Terms and are bound by them. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Modification of Terms
AI Creation Platform reserves the right to modify or replace these Terms at any time. If the modifications are material, we will notify you at least 30 days before the new Terms take effect. The definition of material changes is at our sole discretion.
3. Use of Service
Account Registration
Certain features require you to create an account. You may register using your email or log in through third-party services (such as Google or Facebook) (see our Privacy Policy for details).
You agree to provide accurate, current, and complete information during registration and to update such information promptly. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Accounts are non-transferable.
We reserve the right to suspend or terminate accounts in cases of violation of these Terms or for any other reason.
Purchase and Payment
Certain features require a paid membership purchase. You can purchase Monthly Pass or Credits through our payment processor (such as Stripe). All purchases are one-time payments (not recurring subscriptions). You are responsible for all applicable fees and taxes.
Monthly Pass purchases provide access for the duration of the purchased period (e.g., one month). Once purchased, the membership period cannot be cancelled, but will automatically expire at the end of the purchased period.
User Safety
We encourage you to avoid sharing sensitive personal information in your prompts or uploaded images. While we implement security measures, you are responsible for the information you provide.
Intellectual Property
All content provided by the Service, including designs, text, graphics, logos, icons, images, and their selection and arrangement, is the exclusive property of the Site or its licensors and is protected by copyright law.
4. Intellectual Property
You own the generated images. You retain full ownership and intellectual property rights to the images ("Outputs") generated using the Service.
We do not claim any ownership over your Inputs (text prompts and uploaded images) or Outputs, and we do not use them to train or improve our AI models.
You grant us a limited, non-exclusive, royalty-free license solely to process your Inputs and display/store Outputs to provide the Service to you.
All other intellectual property in the Service (including software, design, and branding) is owned by us or our licensors.
5. Your Responsibilities and Uploaded Images
You represent and warrant that your Inputs do not infringe third-party rights and comply with applicable laws. You are solely responsible for your content and its use.
When uploading reference images (including photographs of real persons):
- You warrant that you have all necessary rights and consents to upload and process the image;
- You must not upload images of others without explicit permission, especially for transformations that could create harmful, misleading, or non-consensual content;
- You bear full responsibility for any legal consequences arising from uploaded images or generated outputs.

6. Storage and Deletion
Uploaded reference images and generated images are stored securely for up to 30 days to allow you to access and download them. After 30 days, they are automatically and permanently deleted. You may also delete them earlier through your account.
7. Restrictions
You agree not to:
- Use the Service for illegal purposes;
- Generate or distribute harmful, abusive, or infringing content (see our Blocked Content Policy);
- Reverse engineer, decompile, or attempt to extract the source code;
- Interfere with the Service or overload our systems;
- Remove or alter any proprietary notices.
8. Content Moderation
We use automated filters and may manually review content that violates our policies. As a small platform, manual review is limited. We reserve the right to remove content or terminate accounts for violations.
9. Third-Party Services
The Service may integrate with third-party providers (such as payment processors, OAuth login). Their terms and privacy policies also apply.
10. Disclaimer
The Service is provided "as is" and "as available." AI-generated content may contain inaccuracies or defects. We do not guarantee that the Service will be uninterrupted, error-free, or meet your specific requirements. For more details, please see our Disclaimer.
11. Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for indirect, incidental, consequential, or punitive damages arising from your use of the Service.
12. Refunds
Due to the nature of AI processing power costs, all sales of 'Monthly Pass' or 'Credits' are final. Once the AI generation process has started, we do not offer refunds. We encourage users to try our free samples before purchasing.
13. Termination
You may stop using the Service at any time. We may terminate or suspend your access for breach of these Terms or for any other reason.
14. Governing Law
These Terms are governed by the laws of Hong Kong, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Hong Kong.
15. Changes to Terms
We may update these Terms from time to time. Material changes will be notified via the Service or email. Continued use constitutes acceptance.
